These Terms of Service ("Terms") govern access to and use of the HiperService website, digital channels (including SMS, RCS, WhatsApp Business and email communications), and the technical services delivered to end-customers on behalf of manufacturers, retailers and brands across Spain and Portugal. By accessing this website or interacting with our digital channels, you accept these Terms in full.
1. Service provider
The provider is HiperService de Arcos, S.L., a company of Warranty Global Group, with VAT ESB81957516 and registered office at C/ Hervidero, 5 — 28750 San Agustín de Guadalix, Madrid (Spain). Full corporate details are available in our Legal Notice.
2. Scope of services
HiperService delivers technical operations on behalf of brands and retailers, including after-sales management, installations, repairs, spare-parts logistics, returns handling, technical helpdesk and field-service coordination. The applicable commercial conditions of each service are defined in the contract with the corresponding principal (manufacturer, retailer or distributor).
3. Acceptable use of digital channels
- Do not interfere with the normal operation of the website or attempt to access non-public areas without authorisation.
- Do not use automated scraping, harvesting or denial-of-service techniques.
- Do not impersonate any individual, technician or representative of HiperService or its clients.
- Do not submit unlawful, defamatory, obscene or infringing content via any contact form or messaging channel.
4. Messaging program
Specific terms for our SMS, RCS, WhatsApp and email messaging program — including supported message types, frequency, opt-out keywords, help instructions, supported carriers, fees and message-and-data rates — are set out in our Messaging Terms, which form an integral part of these Terms of Service.
5. Intellectual property
All trademarks, logos, software, designs and content of this website are the property of HiperService de Arcos, S.L. or its licensors and are protected by Spanish, Portuguese and EU intellectual property law. No licence is granted by mere access to the website.
6. Privacy and data protection
The processing of personal data is governed by our Privacy Policy and our Cookies Policy, both compliant with GDPR, Spanish LOPDGDD and Portuguese Law 58/2019.
7. Limitation of liability
To the maximum extent permitted by applicable law, HiperService shall not be liable for indirect, incidental, consequential or special damages arising from the use of the website or the digital channels. Nothing in these Terms excludes liability that cannot be excluded under mandatory consumer-protection law in Spain or Portugal.
8. Force majeure
HiperService shall not be liable for any failure or delay in performance caused by events beyond its reasonable control, including but not limited to natural disasters, strikes, governmental actions, telecommunications failures or third-party carrier outages affecting messaging delivery.
9. Changes
We may amend these Terms to reflect operational, legal or regulatory changes. The effective date is shown at the top of this page. Continued use of the website after publication constitutes acceptance of the updated Terms.
10. Governing law and jurisdiction
These Terms are governed by Spanish law. Any dispute arising in connection with these Terms shall be submitted to the exclusive jurisdiction of the Courts of Madrid (Spain), without prejudice to mandatory consumer-protection rules and the jurisdiction of Portuguese courts where applicable to users resident in Portugal.
